Viridiant Energy Promise
When you buy a home, you calculate, down to the cent, your monthly mortgage payment. But what about your utility bills? One of the big unknowns when buying a home, utility bills can drive up your monthly expenditures by hundreds of dollars. But what if you could guarantee the cost of heating and cooling costs?
Viridiant’s Energy Promise is a one year guarantee of your annual heating and cooling costs. Viridiant is able to offer this guarantee when the builder participates in the EarthCraft program, a third-party verified green building program, or a similar program. Through computer modeling and on-site assessment throughout the construction process, Viridiant is able to accurately estimate the heating and cooling costs of your home.
Heating and Cooling Guarantee
Viridiant guarantees to the original homeowner for a one year period after the purchase of the home that the energy used to heat and cool the home will not exceed the Guaranteed Usage, as defined in the Energy Analysis below. If the Actual Usage, as calculated in the Energy Analysis, exceeds the Guaranteed Usage for the one year period, Viridiant will reimburse the homeowner for 100% of the cost difference, subject to any exclusions listed in the Limitation of Liability. The reimbursement amount will be calculated using the average of monthly utility rates in effect during the time of the guarantee, not including any taxes, surcharges, or other fees charged by the utility company.
The Guaranteed Usage is calculated using a computer model of your home based on a typical weather year. The monthly guaranteed cost is determined based on the heating and cooling energy use calculated by the model and the utility rates in effect at the time. Therefore, the Guaranteed Usage is subject to adjustment based on any unseasonable weather and the cost may fluctuate based on current utility rates.
Your utility bills include all of the energy usage for your home, not just the energy used for heating and cooling. If you submit a claim, Viridiant will analyze your annual utility data to estimate the portion of your annual energy usage that was for heating and cooling. This will then be compared to the Guaranteed Usage.
The following methodology is used by Viridiant to calculate the heating and cooling energy. The 3 months with the lowest usage over the year are determined. These are typically the months with no, or very low, heating or cooling needs. The usage from the 3 months is averaged and multiplied by 12 to determine the annual baseload consumption. The baseload usage is subtracted from the annual usage and the remainder is considered to be the heating and cooling energy. Adjustments may be made for seasonal energy usage such as pool pumps or hot tubs, or in the event of weather that deviates from a typical year’s weather.
The guarantee shall not take effect unless the home is registered with Viridiant within 30 days of the purchase of the home (30 days from closing). The Guarantee Period will begin on the date of the 2ndmeter reading by the electric utility and will be in effect for 365 days following that. Any claims must be made within 30 days of the end of the Guarantee Period.
The homeowner shall:
- Prudently use windows and doors when the HVAC system is in operation.
- Operate and service the heating, cooling, and ventilation (HVAC) systems as recommended by the manufacturer.
- Change HVAC filters according to manufacturer’s recommendations.
- Maintain the thermostat setting no higher than 72 degrees Fahrenheit when heating and no lower than 74 degrees Fahrenheit when cooling.
- Notify Viridiant of any changes or modifications to the home or HVAC system so that Viridiant may make adjustments to the Guaranteed Usage. Some changes may void the Guarantee.
- In the event that a claim is submitted, allow Viridiant and/or the builder access to the home, upon reasonable notice, to inspect and/or sub-meter the home.
Limitation of Liability
This guarantee does not cover claims due to excessive energy use resulting from the malfunction or improper installation or maintenance of heating, ventilation, and/or cooling equipment or the failure of the homeowner to fulfill the Homeowner Responsibilities. The home is not covered under this guarantee if the Homeowner does not exercise prudent energy management. Abuse, neglect, accident, flood, fire, natural disasters, or other acts of God are additionally not covered. Claims made outside of the Guarantee period will not be considered. Viridiant shall not be liable for any incidental or consequential damages resulting from breach of this Viridiant Energy Promise other than expressly stated above, or any expressed or implied guarantee arising under state law. The homeowner understands that Viridiant makes no warranties which extend beyond the warranty described hereof, including any expressed or implied warranties of merchantability or fitness for purpose.
Making a Claim
All claims must be made within 30 days of the end of the Guarantee Period. Claims must be made in writing and must include the 12 months of energy utility bills covering the Guarantee Period.
